Becoming a U.S. citizen through naturalization requires meeting specific eligibility requirements and submitting complete, accurate paperwork. Legal guidance can be especially important when your history involves extended travel, missing documents, prior legal concerns, or questions involving immigration law. Our attorneys also understand Adjustments of Status, dual citizenship laws, and other aspects of the naturalization and citizenship process.

At Sebastian Simon Law Group, PLLC, our naturalization attorneys in Houston can provide guidance each step of the way. We help clients determine whether they qualify for citizenship, gather the appropriate documents, and prepare Form N-400 accurately. Founding Attorney Sebastian Simon brings personal insight into the U.S. immigration process, which informs how we approach each client’s situation with both precision and care.

How the Naturalization Process Works

Naturalization is the legal process through which an eligible foreign national becomes a U.S. citizen after meeting statutory and regulatory requirements. Form N-400 is the application for naturalization, and completing it accurately requires a full account of your identity, residence history, travel, employment, family, and other requested details.

The process doesn’t end with USCIS approval. An approved applicant formally becomes a U.S. citizen only after taking the Oath of Allegiance.

The steps for the naturalization process include:

  • Preparing and filing your Form N-400 Application for Naturalization
  • Attending a biometrics appointment if USCIS requires one
  • Undergoing a naturalization interview with a USCIS officer
  • Taking the English and civics tests unless an exception applies
  • Responding to any request for additional evidence
  • Receiving a decision from USCIS
  • Taking the Oath of Allegiance if the application is approved

Applicants should also bring documents identified by USCIS to the interview, including the appointment notice, Permanent Resident Card, valid identification, and passports or travel documents showing any absences from the United States. Because processing times vary by case and USCIS office, applicants should check current USCIS estimates for the office handling their application.

Our naturalization lawyers can assist with Form N-400 preparation, document review, and interview preparation. When an application presents documentation concerns or eligibility questions, we work through those issues with the client before filing.

Key Requirements for Naturalization

Eligibility for naturalization depends on several overlapping requirements. The most common route requires five years as a lawful permanent resident; qualifying spouses of U.S. citizens may apply after three years. Both routes require meeting physical presence thresholds: 30 months of physical presence within the five-year period, or 18 months within the three-year period, as identified by USCIS.

Residence, Testing, & Character Requirements

Core eligibility requirements include:

  • Being at least 18 years old and holding lawful permanent resident status for the required period
  • Maintaining continuous residence in the United States for three or five years, depending on your filing category
  • Meeting physical presence requirements during the applicable period
  • Residing in the state or USCIS district where you are filing for at least three months before submitting Form N-400
  • Demonstrating good moral character throughout the statutory period
  • Speaking, reading, and writing basic English, as measured through the English test unless an exception applies
  • Demonstrating basic knowledge of U.S. history and civics through the civics test
  • Showing attachment to the principles of the U.S. Constitution and willingness to take the Oath of Allegiance

Certain situations call for individualized legal review rather than a checklist assessment. Long absences outside the United States, prior arrests or convictions, tax issues, disputed application answers, and incomplete records can each affect eligibility in ways that aren’t resolved by simply reviewing the requirements. We evaluate those complications before filing so that your application reflects your full history accurately.

Personalized Legal Support for Your Citizenship Journey

Travel, incomplete records, testing questions, and prior legal concerns can complicate a citizenship application. We tailor our guidance to your circumstances and explain how those issues may affect your eligibility or filing strategy.

Attorney Sebastian Simon’s own experience with the U.S. immigration process informs how we explain requirements, listen to concerns, and prepare each case.
