K-1 Visa Eligibility Requirements

Before filing a K-1 petition, a couple must meet five conditions set by USCIS.

• U.S. citizenship: Only U.S. citizens may petition for a K-1 visa. Lawful permanent residents aren’t eligible and may instead pursue a CR-1 spouse visa.
• Legal freedom to marry: Both parties must be legally free to marry. Prior marriages must have been terminated by divorce, annulment, or death, and official documentation is required.
• Intent to marry within 90 days: The couple must intend to marry within 90 days of the fiancé’s entry into the United States.
• In-person meeting within two years: The couple must have met in person at least once in the two years before filing Form I-129F. USCIS may grant exemptions for extreme hardship or compliance with strict cultural or social practices, but those exemptions must be properly documented.
• Income threshold: The petitioner must demonstrate income at or above the federal poverty guideline for their household size. A joint sponsor may be used if the petitioner’s income falls short.

The K-1 Process: Petition to Visa Issuance

The K-1 process moves through three stages, each with its own timeline and requirements. Understanding each step helps couples prepare and avoid preventable delays.

Filing Form I-129F with USCIS

The process begins when the U.S. citizen files Form I-129F, the Petition for Alien Fiancé, with USCIS. This petition establishes the relationship and initiates the K-1 case. Houston-area petitioners typically complete biometrics at the Houston USCIS Field Office as part of the review. Once USCIS approves the petition, it transfers to the National Visa Center, which forwards it to the U.S. Embassy or consulate in the fiancé’s home country.

Consular Interview & Visa Issuance

The fiancé attends a consular interview where the officer evaluates documentation, relationship evidence, and eligibility. We’ve represented clients in matters involving U.S. Consulates abroad and support the fiancé through the documentation and preparation required at this stage. A visa issued by the consulate doesn’t guarantee admission into the United States; the fiancé must also pass inspection at the port of entry. Total time from filing to visa issuance is generally estimated at six to nine months, though USCIS service center workload, consulate scheduling, and application completeness all affect the actual duration.

After Entry: Marriage, Adjustment of Status, & the Path to a Green Card

Once the fiancé enters the U.S. on a K-1 visa, the 90-day clock starts. The couple must marry within that window. Failure to do so means the fiancé loses lawful status and may face removal proceedings.

After marrying, the spouse may file Form I-485 (Application to Register Permanent Residence or Adjust Status) to become a lawful permanent resident. During this process, the spouse may also apply for work authorization. If the marriage is less than two years old when the green card is approved, USCIS issues a conditional green card valid for two years; the couple must later file Form I-751 to remove those conditions and receive a permanent 10-year green card. If the marriage is two years or older at approval, the 10-year card is issued directly.

Unmarried children under age 21 of the K-1 visa holder may enter the U.S. on K-2 visas and follow a similar adjustment of status path once the K-1 holder has married.
