Three Types of Immigration Waivers
The United States Citizenship and Immigration Services (USCIS) allows the issuance of several types of waivers, each one used for a specific situation. The three main types of immigration waivers are:
- I-601 Waiver of Inadmissibility: Someone seeking entry into the United States using an immigrant visa or adjustment of status but deemed ineligible due to conditions that break qualifications might be able to use an I-601 Waiver. Applicants should be able to prove that a close relative or family member would experience undue hardship if they were not permitted to stay within the U.S. with them.
- I-601A Provisional Waiver to Remain: Immigrants ineligible to remain in the U.S. under typical conditions and qualifications but who do not need to stay in the country to protect or care for a close relative can use an I-601A Provisional Waiver to Remain in the United States. The I-601A allows the applicant to travel back to their country of origin, pass an immigration interview, and return to the U.S., all within a matter of a few days, in most cases.
- I-212 Waiver of Inadmissibility: An immigrant that has been deported, either due to being convicted of criminal offenses or simply due to illegal immigration, faces a difficult task when attempting to reenter. An I-212 Waiver may be the only means of gaining permission to reenter the country.
